Reinstatement Hearings
Secretary of State Reinstatement Hearings
If your driver’s license has been revoked by the state of Illinois due to a DUI, you must attend a Secretary of State Reinstatement Hearing in order to have your license reinstated. The vast majority of people who attend these hearing without a qualified Illinois DUI defense lawyer are denied.
Jerald Novak & Associates has helped thousands of people get their driving privileges restored at Secretary of State Reinstatement Hearings. I concentrate on DUI defense and reinstatement hearings. I understand the reinstatement process, and I am well versed in the expectations set by the Secretary of State’s office. I am the only attorney in the state of Illinois to have written a book specifically on Secretary of State Hearings, Secretary of State Guide to Driver’s License Reinstatement.
Restricted Drivers Permit Hearing
Due to my experience and preparation, the vast majority of the people I represent receive a Restricted Drivers Permit (RDP) at their first hearing. A Restricted Drivers Permit allows people to drive to and from work and to attend alcohol support meetings such as Alcoholics Anonymous (AA).
Preparation for a Secretary of State Hearing
Preparation is the key to successful Secretary of State Reinstatement Hearing. Prior to the hearing most people, who have had the drivers license revoked due to a DUI, must complete an alcohol and drug evaluation prepared by a licensed evaluator, alcohol treatment ranging from zero to seventy five hours depending on the evaluators recommendation, and Driver Risk Education.
I work with each of my clients to prepare them to answer a few fundamental questions that will be asked about their alcohol problem:
- How have you changed?
- How have you resolved your past problem with alcohol?
- What have you learned about yourself from this experience?
- What have you gained from the education and treatment program?
- What specific changes you have made in your life since your last DUI arrest and how the Secretary of State can rely on you and trust you with a driver’s license
After receiving a Restricted Driving Permit, we must wait nine months before requesting full reinstatement of your driving privileges. After nine months there will be another formal hearing to request your full license. It can take between nine and ten months to get you driver’s license back, without restrictions. I have successfully worked to get licenses back for people who have had multiple infractions as well as people who serve time in prison for DUI offenses.
