Ignition Interlock Devices

Protecting Your Rights Under the BAIID Law

Since January of 2009, Illinois law has required that even first-time offenders arrested for DUI must have a breath alcohol ignition interlock device (BAIID) installed in their vehicle in order to drive on a driving permit during the period when their driver’s licenses are automatically suspended because of the DUI defense. . This ignition interlock law raises numerous administrative and legal issues that are best handled with the help of an experienced DUI defense lawyer.

Ignition Interlock Issues

The Breath Alcohol Ignition Interlock Device (BAIID) is installed underneath the vehicle’s dashboard. It is not visible. However, each time you start the vehicle you must submit to a breath test. If the breath alcohol content (BAC) is above a certain level either the vehicle will not start or a report is generated to the Secretary of State and you will be notified to explain that breath score. It sounds simple enough, but technology is not always the quick, easy fix it is intended to be. Issues that can arise include:

  • What if someone else (a friend, family member or parking lot attendant) blows into the device instead of the person whose is on the driving permit?
  • What if the BAIID readings are skewed by the presence of residual mouth alcohol caused by the presence of starches in bread, pasta and other foods? Are you guilty for driving under the influence of spaghetti? It isn’t fair to restrict someone’s driving just for eating food they like.
  • What if the BAIID malfunctions due to extreme heat, cold, or humidity? What if the BAIID malfunctions due to automobile mechanical failure

The experienced defense lawyers at Jerald Novak & Associates can help you resolve these and other issues related to ignition interlock devices.
